Shamrock Rose Aussies - Sale Contract
I, Doris Vergona, the breeder / owner of the said puppy (described below), hereafter "Breeder", do enter into an agreement with _______________________hereafter "Buyer", for the purpose of transferring ownership of the said puppy.

The said puppy is a purebred Australian Shepherd, male/ female, sired by __________________, out of _____________________. The puppy is ______________ in color. The puppy's date of birth is ___________. The breeder will transfer ownership of the said puppy for _______, to be paid in full before the buyer takes possession of the puppy.
GENERAL PROVISIONS:
The breeder reserves the right to refuse sale of any puppy/ dog to anyone.
This sales contract is non- transferable.
All puppies are sold as pet quality, and are warranted only for the purpose of being a companion animal. Although the puppy may have exceptional structure and may be capable of excellence in the show ring, no warranty is provided by the breeder as to the purpose of breeding or showing the puppy.
Breeder does not guarantee the size of the puppy. Breeder will give an estimated mature height and weight based on the height and weight of the parents and their backgrounds.
The breeder will supply up to date health records to the buyer at the time of transfer of the puppy.
Registration papers for the Australian Shepherds will be provided as part of this agreement, and will be provided to the buyer upon full payment of the puppy.
BUYER RESPONSIBILITIES:
The buyer is responsible for all costs of shipping. This includes airline fair, appropriate size crate, transportation to the airport, and cost of updating the health certificate for transportation.
The buyer agrees that the puppy will live with the buyer, will have adequate exercise, nutritious food, and necessary health care by a licensed veterinarian - including a yearly health examination and appropriate vaccinations.
The buyer agrees to keep the puppy on heartworm preventative medication, which will be started by the breeder.
The buyer agrees to spay/ neuter the puppy before its first birthday unless breeding rights are given.
The buyer is strongly encouraged to attend puppy, conformation, and obedience classes with the puppy and to provide proper socialization for the puppy.
The buyer agrees to have the puppy examined by a licensed veterinarian within three (3) days of taking possession of the puppy.
If the puppy is determined to be in poor health, as evidenced by a veterinarian's written statement, the buyer can elect to keep the puppy, assuming all costs of the puppy's care, or may return the puppy for a full refund (shipping is the sole responsibility of the buyer).
A Veterinarian's written statement regarding the health of the puppy must be provided to the breeder. This provision will expire 72 hours after the buyer takes possession of the puppy.
If buyer can no longer take proper care of puppy and can no longer keep the puppy, buyer must either find a proper home for the puppy where proper veterinarian care, food, exercise, and companionship are provided or return puppy to seller with no refund of purchase price.
Prior to returning puppy to seller, all vaccinations must be up to date and puppy must be in good health
BREEDERS GUARANTEES:
The breeder guarantees the puppy is healthy, free of known contagious diseases, and has had vaccinations and worming appropriate for its age at the time of purchase, and upon the buyers receipt of the puppy.
The breeder guarantees that the puppy is free from genetic disorders that are life threatening or limiting. Buyer must provide a statement from either OFA (hip/elbow/patella disorders), a Veterinary Ophthalmologist for eye disorders, or a University Clinic Veterinarian for other genetic disorders.
Options:
Should puppy have a genetic disorder that is life threatening or limiting,
1) Buyer may decide to keep the puppy, assuming all costs of care. Buyer must spay or neuter the puppy, and provide all Veterinarian documentation to the breeder. The breeder will then refund one half the purchase price of the puppy.
2) Buyer may return the puppy to the breeder at the buyers expense. The breeder will provide a replacement puppy of equal value within 12 months. Breeder reserves the right to have a third opinion on the diagnosis from the Veterinarian of Breeder's choice. At this time buyer must sign over all registration papers to the breeder.
3) If the puppy must be put down due to genetic defects, a written statement from two (2) licensed Veterinarians from two different clinics (one must be from a University Clinic) must be provided to the breeder stating that it was medically necessary to put the puppy down due to genetic defects. The breeder will then replace the puppy with a puppy of equal value within 12 months. Buyer must return all registration papers.
If either the breeder or the buyer takes legal action regarding this contract, that action shall be initiated in Hernando County, Florida
